Terms of Service

Introduction

These Terms of Service (“Terms”) govern your use of the Brook Blend Field website and the engagement of plumbing and equipment installation services provided by Brook Blend Field (“we”, “us”, “our”). By using our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

Our Services

Brook Blend Field provides residential and commercial plumbing services including, but not limited to:

  • Emergency plumbing call-out and repair for burst pipes, leaks, and blockages
  • Water heater supply, installation, and commissioning from certified manufacturers
  • Pipe repair, replacement, and trenchless relining for hidden pipe networks
  • Acoustic and thermal leak detection surveys with written diagnostic reports
  • Drain and sewer cleaning, CCTV inspection, and unblocking services
  • Complete bathroom and kitchen plumbing fit-outs for residential and commercial projects
  • Annual maintenance plans with scheduled inspections and discounted call-out rates

Service pricing, availability, and terms vary based on the specific service requested. We reserve the right to decline any service that falls outside our technical scope or licensing authority.

Quotes and Pricing

All prices listed on the Brook Blend Field website are indicative starting prices and exclude Japanese consumption tax (10%) unless otherwise stated. A written itemised quote will be provided before any work commences, detailing labour, parts, disposal, and any additional costs. The quoted price constitutes our offer; work begins only upon your written or verbal acceptance of the quote.

Quote validity is 30 days from issue. We reserve the right to revise a quote if the scope of work materially differs from the original assessment upon on-site inspection. Any revision will be communicated and agreed in writing before proceeding. Price escalations due to material cost increases beyond our control will be negotiated fairly with the customer.

Payment Terms

Payment is due in full upon completion of the agreed works unless a separate payment schedule has been agreed in writing. We accept bank transfer (preferred), credit card, and cash. For larger commercial projects exceeding ¥500,000, milestone-based payment schedules (typically 50% upon agreement, 50% upon completion) may be arranged by prior agreement.

Late payments may incur a monthly interest charge of 3% per month, compounded. We reserve the right to withhold warranty coverage if payment remains outstanding after 30 days of invoice date. All disputes regarding invoices must be raised within 7 days of receipt.

Workmanship Guarantee

Brook Blend Field provides a 12-month workmanship guarantee on all completed repair and installation work. This guarantee covers defects in our workmanship that arise under normal use conditions during the 12-month period. It does not cover damage caused by misuse, modifications made by third parties after completion, normal wear and tear, damage from external factors (earthquakes, flooding), or repairs made by non-Brook Blend Field technicians.

To claim under the warranty, the customer must notify us within 7 days of discovering the defect. We will inspect the issue and remedy it at no additional cost within 14 days. Manufacturer warranties on parts and equipment are separate from and in addition to our workmanship guarantee, and the customer may claim directly with manufacturers as applicable.

Limitation of Liability

To the fullest extent permitted by applicable Japanese law, Brook Blend Field’s total liability to you for any claim arising from the provision of our services shall not exceed the amount paid by you for the specific service that gave rise to the claim. In no event shall Brook Blend Field be liable for indirect, consequential, special, or punitive damages, including loss of profits, business interruption, or loss of data, even if advised of the possibility of such damages.

This limitation applies to all claims whether based in contract, tort, negligence, or any other legal theory. Our insurance policy provides additional coverage for property damage up to ¥100,000,000. The foregoing limitation does not apply to claims for personal injury or death, or to liability that cannot be excluded under applicable law.

Cancellation and Rescheduling

You may cancel or reschedule a non-emergency booking without charge by providing at least 24 hours’ notice via phone or email. Cancellations made with less than 24 hours’ notice (but more than 2 hours) will incur a ¥5,000 cancellation fee. Cancellations made within 2 hours of the scheduled appointment or no-shows will incur the full call-out fee (typically ¥15,000). Emergency bookings cannot be cancelled once a technician has been dispatched.

Brook Blend Field reserves the right to reschedule appointments due to emergencies or operational requirements. We will provide as much notice as possible (minimum 24 hours when feasible) and offer alternative appointments at no extra cost. Repeat reschedules by Brook Blend Field beyond two occasions may justify a discount on your next service.

Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Japan, without regard to conflicts of law principles. Any disputes arising out of or in connection with these Terms, your use of our website, or our services shall be subject to the exclusive jurisdiction of the Tokyo District Court.

Before pursuing legal proceedings, we encourage both parties to attempt resolution through good-faith negotiation. If negotiation fails, the matter shall be submitted to the Tokyo District Court. The prevailing party in any dispute may recover reasonable attorneys’ fees and costs.
